Foto Master LLC and its affiliates ("Foto Master," "we," "us," or "our") are committed to protecting privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when people interact with our websites, mobile applications, Cloud services, software, AI services, and related services (collectively, the "Services").
This Policy applies both to information Foto Master handles for its own business purposes and to information it processes on behalf of business customers. The role Foto Master performs depends on the context, as explained below.
1. Information We Collect
1.1 Information You Provide
We may collect information that you voluntarily provide through the Services or in communications with our team, including:
- Contact information, such as name, business name, email address, shipping and billing address, and phone number.
- Account and authentication information, such as username, password, account administrators, and license or device identifiers.
- Verification information, such as copies of an identification document when reasonably required to verify a purchase, account, or authorized request.
- Order, subscription, billing, support, training, and customer-service information.
- Communications and information you submit through forms, email, phone, chat, surveys, or feedback tools.
- Customer and event content, including photos, videos, audio, event details, prompts, settings, generated outputs, and other files submitted to the Services.
1.2 Information Collected Automatically
When you use the Services, we may automatically collect:
- Device and browser information, IP address, operating system, language, and approximate location derived from IP address.
- Usage and diagnostic information, such as pages visited, features used, session duration, clicks, errors, performance, and security events.
- License, Cloud, account, and device activity needed to provide the Services, prevent abuse, and protect accounts.
- Cookie, advertising, and analytics information, subject to applicable consent requirements and the choices available through our website.
1.3 Payment Information
Payments are processed by third-party payment providers. Foto Master does not store full payment card numbers, but may receive limited transaction information such as payment status, card type, billing contact information, and transaction identifiers.
1.4 End-User and Event Content
Business customers may use the Services to collect, upload, process, generate, store, or share content involving event participants and other individuals. This content may include personal information and images or recordings of faces. The customer or event operator is responsible for providing required notices and obtaining all permissions, releases, consents, and parental or guardian authorizations required for its collection and use of that content.
1.5 Information Entered in Forms
When you use forms on our website, we may collect information progressively as it is entered, including information entered in a partially completed form, for lead follow-up, fraud prevention, troubleshooting, and improving the form experience, subject to applicable law and consent requirements.
2. How We Use Information
We may use personal information to:
- Provide, operate, maintain, secure, troubleshoot, and improve the Services.
- Process orders, payments, deliveries, subscriptions, licenses, AI Credits, and account changes.
- Verify identity, prevent fraud and abuse, enforce agreements, and protect Foto Master, customers, and users.
- Provide support, training, product notices, renewal reminders, and service communications.
- Personalize features and analyze performance, usage, and customer needs.
- Process prompts, media, and other inputs; generate requested outputs; and, as described in Section 4, develop, evaluate, improve, and train AI and machine-learning systems.
- Send marketing communications and measure advertising, where permitted and subject to available choices.
- Comply with law, respond to lawful requests, and establish, exercise, or defend legal claims.
Where the GDPR or similar law applies, our legal bases may include performance of a contract, compliance with a legal obligation, legitimate interests that are not overridden by individual rights, consent, and the establishment or defense of legal claims.
3. How We Disclose Information
We may disclose personal information in the following circumstances:
- Service providers and subprocessors: Vendors that support hosting, storage, content delivery, AI processing, analytics, payment processing, shipping, communications, customer support, security, and other business operations.
- Advertising and analytics partners: Partners that help measure campaigns or deliver relevant advertising, subject to applicable consent and opt-out rights.
- Lead Distribution Platform: If you submit an event-rental request and consent to referral, we may share the request with Foto Master customers that offer services in your area.
- Business transfers: Parties involved in an actual or proposed financing, merger, acquisition, reorganization, or sale of all or part of our business or assets.
- Legal and safety purposes: Government authorities, courts, advisers, or other parties when reasonably necessary to comply with law, protect rights and safety, investigate misuse, or enforce agreements.
- With direction or consent: Other parties when you or the applicable business customer directs or authorizes the disclosure.
Where Foto Master acts as a processor, current subprocessor information and the process for notice of intended additions or replacements are provided to covered customers through the applicable Data Processing Agreement ("DPA") process.
4. AI Services, Customer Content, and Model Training
Customers retain ownership of the content they submit, subject to third-party rights. By submitting content to the Services, the customer grants Foto Master and its service providers a worldwide, non-exclusive license to host, copy, transmit, display, transform, analyze, and otherwise process that content as needed to provide, secure, support, develop, and improve the Services.
This license includes using submitted prompts, settings, photos, videos, audio, other inputs, and generated outputs to evaluate, test, improve, and train Foto Master and third-party AI or machine-learning models and systems, where permitted by applicable law. Foto Master may use aggregated or de-identified data where appropriate. If a signed DPA, order form, or other written agreement expressly restricts model training for a particular customer, that specific agreement controls.
AI outputs may be inaccurate, incomplete, or similar to outputs generated for others. Customers must review outputs before use and are responsible for having the rights, notices, permissions, and consents required for submitted content, people depicted in media, prompts, and intended uses. Customers may not use the Services for unlawful impersonation, deceptive deepfakes, harassment, discrimination, biometric identification databases, infringement, or other unlawful purposes.
Some AI features rely on third-party AI providers. Those providers may process inputs and outputs to provide the requested feature and as otherwise permitted by the applicable agreement with Foto Master.
5. Photos, Faces, Biometric Information, and Children
The Services are designed for business customers and adult operators and are not directed to children under 13. Foto Master does not knowingly permit children under 13 to create accounts or submit personal information directly to Foto Master. If we learn that a child under 13 submitted personal information directly without required authorization, we will take appropriate steps to delete it.
Adults and business customers may upload event media that depicts children. They may do so only when they have lawful authority and any parental or guardian permission required for the collection, processing, sharing, AI use, and model-training uses described in this Policy.
Photos and videos may contain faces, and some features may analyze visual characteristics to create requested effects or outputs. Customers must not use the Services to identify or authenticate individuals, create a biometric identification database, or process biometric identifiers or biometric information unless the use is expressly authorized by Foto Master and complies with all applicable notice, consent, retention, and deletion requirements.
6. Data Retention and Deletion
We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, maintain business and transaction records, comply with legal obligations, resolve disputes, prevent abuse, and enforce agreements. Retention depends on the type of information and context:
- Account, order, billing, tax, and transaction records may be retained for the life of the account and longer where required for legal, accounting, fraud-prevention, or dispute purposes.
- Support, sales, form, and business communications are retained as needed to respond, maintain records, and manage the relationship.
- Cloud and event content is generally retained while the applicable account or plan remains active, subject to customer deletion controls, storage limits, the Subscription and Cancellation Policy, destructive plan downgrades, account deletion, and any applicable grace period.
- Security, diagnostic, analytics, and advertising information is retained for periods appropriate to the operational, security, measurement, and legal purpose for which it was collected.
- AI training and evaluation data may be retained for the useful life of the applicable model or dataset, subject to applicable law and any controlling written agreement.
When retention is no longer necessary, we delete, de-identify, or securely dispose of information. Backup and disaster-recovery copies may remain for a limited period before being overwritten.
7. Privacy Rights and Choices
Depending on your location and applicable law, you may have rights to:
- Request access to or a copy of personal information.
- Request correction or deletion.
- Request restriction of processing or object to certain processing.
- Receive certain information in a portable format.
- Withdraw consent where processing relies on consent.
- Opt out of targeted advertising or the sale or sharing of personal information as those terms are defined by applicable law.
- Limit certain uses of sensitive personal information.
- Appeal a denied request and receive equal service without unlawful discrimination for exercising privacy rights.
Foto Master does not sell personal information for money. Some advertising-related disclosures may be considered "sale," "sharing," or targeted advertising under certain privacy laws. Where required, you can use the privacy choices made available on our website or contact support@fotomaster.com.
We may need to verify your identity and authority before completing a request. Authorized agents may submit requests where permitted by law, but we may require evidence of authorization. Some rights are subject to legal exceptions.
8. Cookies and Tracking Technologies
We use cookies and similar technologies to operate the Services, remember preferences, understand performance, prevent fraud, measure campaigns, and deliver advertising. These may include:
- Strictly necessary technologies: Required for security, checkout, account access, and core functions.
- Performance and analytics technologies: Used to understand usage and improve functionality.
- Advertising technologies: Used to measure and personalize advertising where allowed.
You can use the privacy choices presented on our website and browser controls to manage non-essential technologies. Disabling technologies may affect some features.
9. Marketing Communications
We may send promotional email or messages where permitted. You can unsubscribe using the link in a message or by contacting support@fotomaster.com. Transactional and service messages, such as security, billing, support, and renewal notices, may still be sent when necessary.
10. Security
Foto Master uses reasonable administrative, technical, and organizational safeguards designed to protect personal information. No system or transmission method is completely secure. Customers are responsible for safeguarding credentials, managing account administrators, configuring event and sharing settings, and promptly reporting suspected unauthorized access.
11. International Data Transfers
Foto Master operates internationally, and information may be processed in the United States and other countries that may have different data-protection laws. Where required, we use appropriate transfer mechanisms, which may include adequacy decisions, contractual safeguards, or Standard Contractual Clauses.
12. Controller, Processor, DPA, and GDPR Information
Foto Master generally acts as a controller for its website, account, sales, support, security, business analytics, advertising, and service-development purposes, including the AI improvement and model-training purposes described in this Policy. Foto Master may act as a processor when a business customer uses the Services to process event or end-user content on that customer's documented instructions.
Where required, Foto Master makes a DPA available upon request to eligible business customers. The DPA is a separate binding agreement and is not automatically integrated into the EULA. To request a DPA, contact support@fotomaster.com. The DPA addresses processing instructions, confidentiality, security measures, incident notice, assistance with individual rights, deletion or return, audits, subprocessors, and international transfers.
When general authorization for subprocessors applies, Foto Master provides covered controllers with the names of subprocessors and notice of intended additions or replacements through the method specified in the DPA, giving the controller an opportunity to object as provided there.
Business customers remain responsible for their own notices, legal bases, participant consents, event signage, privacy requests, retention choices, and other controller obligations. Foto Master provides tools and assistance, but customers should obtain their own legal advice about their use of the Services.
13. External Links
The Services may link to third-party websites or services. Foto Master is not responsible for their privacy practices. Review the privacy policies of third parties before providing information to them.
14. Changes and Contact Information
We may update this Policy to reflect changes in the Services, law, or our practices. We will post the updated version and revise the "Last Updated" date. We will provide additional notice where required.
